What is Product Liability?

People, businesses, or entities that manufacture or make any products available to the public are held responsible for the injuries those products cause.  This is the legal concept known as Product Liability. 

All of the parties involved throughout the chain of manufacture of a product are held responsible for the safety of their products.  This includes the original manufacturer, an assembling manufacturer, the wholesaler, and the eventual retail establishment or store.  Products that contain defects that cause or directly result in an injury or injuries form the basis for Product Liability claims. 

The laws surrounding product liability vary among jurisdictions and may even result in large class-action suits.  Product Liability lawsuits may be based on negligence, strict liability, or breach of warranty depending on the jurisdiction.  Regardless of the jurisdiction, there are three possible types of product defects:  design defects, manufacturing defects, and/or marketing defects.
